Eastbourne man back in court a week after curfew ends
A 20-YEAR-OLD who swore at police a week after completing a curfew order has appeared in court.
James Millgate was spotted by police officers on duty in Eastbourne town centre in the early hours of July 8.
They saw the Britten Close resident walking past the now closed Funktion Rooms and noticed he was covered in blood.
Eastbourne magistrates heard they approached the defendant, who was with a group of friends, and observed that most of them had consumed alcohol.
They noticed Millgate had a small wound to the back of his head and when they asked for details he refused to give them any.
One of his friends told police that he (Millgate) had nearly got into a fight with somebody near a kebab shop but the injury was caused by him falling over.
Officers told Millgate to go home but he was seen shortly afterwards in Seaside, ripping at his t-shirt and gesturing he wanted to fight someone.
The court heard he was loud, seemed agitated and was throwing his arms around.
Police intervened and told him to go home but he was swearing towards police officers and friends and was subsequently arrested.
He pleaded guilty to using threatening words or behaviour or disorderly behaviour likely to cause harassment, alarm or distress.
Representing himself, he said, "It was a regrettable action of mine, I shouldn't have been so silly. I did let loose a bit.
"I don't want to go back on a tag or more hours.
"I'm trying to keep away from town now and I'm going to university in September."
Millgate was given a conditional discharge for 12 months and ordered to pay 85 costs.
